By accessing or using Otumia's services, website, or platform (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.

2. Service Description

Otumia provides an AI-powered growth platform for home service businesses, including but not limited to: AI receptionist (voice and chat), website design and hosting, search engine optimization (SEO), review automation, online booking, and business integrations.

Service features and availability may vary by subscription plan. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account and to update it as needed.

You must notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.

4. Payment Terms

Subscription fees are billed monthly or annually, depending on your selected plan. All fees are in US dollars and are non-refundable except as described in our 30-day money-back guarantee.

Free trial: New accounts receive a 30-day free trial. No credit card is required to start.
Setup fees: Growth and Pro plans include a one-time setup fee of $497, payable at the start of service after your trial.
Billing cycle: Subscriptions automatically renew at the end of each billing period unless cancelled.
Price changes: We will notify you at least 30 days in advance of any price changes to your plan.

5. Cancellation & Refunds

You may cancel your subscription at any time from your dashboard or by contacting support. Upon cancellation:

Your service continues until the end of your current billing period.
Your website will be transferred to you at no additional cost.
AI receptionist and other active services will stop at the end of the billing period.
There are no cancellation fees.

If you cancel within the first 30 days, you are eligible for a full refund of subscription fees (setup fees are non-refundable after work has commenced).

6. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation
Transmit harmful, fraudulent, or deceptive content
Interfere with or disrupt the Service or its infrastructure
Attempt to gain unauthorized access to any part of the Service
Use the AI receptionist for purposes other than legitimate business communication
Resell or redistribute the Service without our written consent

7. Intellectual Property

The Service, including its design, code, AI models, and content, is owned by Otumia and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your business.

Content you provide (business information, images, text) remains your property. You grant us a license to use it to provide the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Otumia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, profits, or data, arising from your use of or inability to use the Service.

Our total liability for any claim arising from these terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Harris County, Texas.
